1. Acceptance of Terms

By accessing or using the RokoAI platform available at rokoai.com.au, you agree to be bound by these Terms of Service. If you do not agree with these terms, you must not use the platform.

2. Nature of the RokoAI Platform

RokoAI provides access to a software platform that helps businesses manage leads, communications, automation, customer records, marketing activities, and related workflows.

RokoAI acts solely as a technology platform and interface that enables users to manage their own business processes. RokoAI does not operate or control the businesses using the platform and does not participate in communications between users and their customers.

3. Third-Party Infrastructure

The RokoAI platform operates using trusted third-party technology providers and infrastructure systems that enable features such as CRM management, automation, messaging services, hosting, analytics, and payment processing.

Users acknowledge that parts of the platform rely on external providers and that data may be processed through these systems as part of delivering the service. RokoAI does not control the operations, uptime, reliability, or performance of these third-party services.

4. User Responsibility

Users are fully responsible for all activities conducted through their RokoAI account. This includes but is not limited to:

  • Customer data uploaded to the platform
  • Marketing messages sent through the platform
  • SMS, email, or other communications
  • Compliance with privacy, spam, and marketing laws
  • Customer relationships and disputes

RokoAI does not review, monitor, or control communications sent by users to their customers.

5. Prohibited Use

Users must not use the platform to:

  • Send spam or unsolicited communications
  • Violate privacy or marketing laws
  • Distribute unlawful, harmful, or misleading content
  • Conduct fraudulent activities
  • Attempt to interfere with the platform's security

RokoAI reserves the right to suspend or terminate accounts that violate these rules.

6. Platform Availability

RokoAI aims to maintain reliable service but does not guarantee uninterrupted access to the platform. Service interruptions may occur due to system maintenance, technical issues, third-party infrastructure failures, or internet/hosting disruptions.

RokoAI is not responsible for any losses resulting from service interruptions.

7. Limitation of Liability

To the maximum extent permitted by law, RokoAI shall not be liable for any damages, losses, or claims arising from the use of the platform. This includes but is not limited to:

  • Loss of business or revenue
  • Loss of profits
  • Loss of customers
  • Loss of data
  • Marketing performance
  • Service interruptions
  • Third-party infrastructure failures

The RokoAI platform is provided strictly on an "as-is" and "as-available" basis. By using the platform, users acknowledge that they use the system entirely at their own risk.

8. Indemnification

Users agree to indemnify and hold harmless RokoAI, its owners, operators, and partners from any claims, damages, liabilities, legal costs, or expenses arising from:

  • Misuse of the platform
  • Violation of laws or regulations
  • Disputes with customers
  • Unlawful marketing activities
  • Data uploaded or processed by the user

9. Data Ownership

Users retain ownership of all data they upload to the platform. RokoAI does not claim ownership of customer data and is not responsible for the accuracy, legality, or management of that data.

10. Termination

RokoAI may suspend or terminate access to the platform if:

  • These Terms are violated
  • Illegal activity is suspected
  • Payment obligations are not met
  • Platform misuse is detected

11. Changes to Terms

RokoAI may update these Terms of Service at any time. Continued use of the platform after updates constitutes acceptance of the revised terms.

12. Governing Law

These Terms are governed by the laws of Australia.
